Effective Date: The date on which the customer becomes a client of PicklePartner Rentals.

This agreement outlines the Terms and Conditions between Pieter Johannes van der Walt, including any of his employed or affiliated companies (“the Company”), and the customer (“You” or “the Renter”) for the rental of pickleball-related equipment. By renting equipment, You agree to the following terms:

1. Rental Terms and Usage

1.1. Rental Period:

• The rental period begins at the agreed-upon time and ends when the equipment is returned to the Company in its original condition.

1.2. Authorized Use:

• The equipment is to be used solely for its intended purpose and in compliance with all local laws and regulations.

2. Fees and Payment

2.1. Rental Charges:

• Titan Machine (300 Ball Capacity):

  • $25/hour (2-hour minimum).

  • $120/day (08:00–18:00).

• Pickleball Retriever:

  • $15 per rental.

2.2. Refundable Deposit:

• A refundable deposit of TBC is required and will be refunded within 7 business days after equipment inspection.

2.3. Additional Fees:

• Missing balls will be charged at $4 per ball or current replacement cost plus 15%, whichever is higher.

• Damage or excessive wear will incur additional charges as per Section 4.

3. Liability and Indemnification

3.1. Customer Responsibility:

• You accept full responsibility for the equipment during the rental period, including loss, theft, or damage.

3.2. Indemnification:

• You agree to indemnify and hold harmless Pieter Johannes van der Walt, his employed or affiliated companies, and their agents from any claims, liabilities, or damages arising from:

  • Your use of the equipment.

  • Injury, loss, or damage caused during the rental period.

3.3. Legal Fees and Costs:

• You are liable for all legal fees, import fees, and other costs incurred by the Company to recover damages or unpaid fees.

4. Damage, Loss, and Repairs

4.1. Damage and Repairs:

• You are responsible for repair costs (parts and labor) or replacement costs for irreparable equipment.

4.2. Replacement Costs:

• Replacement costs include the full market value of the equipment, shipping, and a 15% administrative fee.

5. Cancellations and Refunds

5.1. Cancellations by the Customer:

• Cancellations made 48 hours or more before the rental start time receive a full refund.

• Cancellations made less than 48 hours but more than 24 hours before the start time incur a 50% cancellation fee.

• Cancellations within 24 hours or no-shows receive no refund.

5.2. Cancellations by the Company:

• If the Company cancels due to unforeseen circumstances, a full refund will be provided or the rental rescheduled.

6. Equipment Pickup and Return

6.1. Pickup Location:

• Equipment must be picked up and returned at 111 Skyland Drive, Kelowna.

6.2. Return Condition:

• Equipment must be returned clean and in good condition.

7. Governing Law

This agreement is governed by the laws of the Province of British Columbia, Canada.
